2025 Legislative Session is Off and Running 

 

The 2025 Regular Legislative Session started last week, and we are already seeing bills of interest move through the process. Now that session is in full steam following the Easter break, I will send a Capitol Calculus email every Friday updating members on the most recent happenings at the legislature, specifically related to the bills we have taken a position on or monitoring. I may also send Capitol Calculus call to action emails when it looks like we will need members to send emails to legislators asking them to support or oppose certain legislation.

ACECL Bill HB 312 Moves Forward

ACECL sponsored bill, HB 312 by Rep. Gadberry, passed unanimously out of House Transportation this morning. 

 

HB 312 is attempting to close a loophole in the Hammett Act by requiring QBS procurement when any public dollars (state or local) are being used for engineering or surveying. Currently, the law only states that a 'public entity' cannot consider price or price related information when selecting A/E services. Recognizing the limiting language, some public entities have required their prime designers (private entities) to solicit bids from their A/E subs after the public entity selected the prime using QBS. This is a clear circumvention of the law that will no longer be allowed when the bill passed. The legislation also adds that any private entity contracted by a public entity to deliver a project or program of project must also adhere to the Hammett Act.
